These terms govern your use of the Grownhome app. They describe what the app does, what you may contribute to it, and — just as importantly — what we do not promise about the farms and sellers you find through it.
Agreement to these Terms
By using Grownhome you agree to these terms. If you do not agree with them, do not use the app. The app is provided and operated under the name Grownhome (“we”, “us”), from Quebec, Canada.
The operator’s full legal name will be published here before the app is released, and will match the developer name shown on its store listings.
Grownhome has not been released yet. These terms are published so that the app can be reviewed and submitted to the app stores, and they will be updated as the app develops.
Who may use Grownhome
Grownhome is intended for all ages. The app has no sign-up: there are no accounts, no profiles and no passwords, so there is nothing for you to register or secure. You are responsible for how the app is used on your device.
A subscription is a payment commitment, and in most places a minor cannot enter into one alone. If you are under the age of majority where you live, you may use Grownhome only with the agreement of a parent or guardian, and only they may start a paid subscription. By subscribing you confirm you are old enough to do so, or that the person responsible for you has agreed.
What Grownhome is, and what it is not
Grownhome is a discovery tool. It shows you farms, farmers markets and local producers on a map, tells you roughly how far away they are, and tags them with what they produce so you can decide where to go.
To be direct about what it is not:
- It is not a shop. We do not sell food, and we are not a party to anything you buy from a farm or market you found through the app.
- It is not a delivery service, an ordering service or a booking service. You pay us for access to the app; you do not pay for food through it, and we do not process payments to farms or sellers.
- It is not an inspection, certification or accreditation service. A place appearing on the map is not us vouching for it.
Every farm, market, producer and business you find through Grownhome is independent of us. We do not own, operate, supervise, employ or control any of them.
Listings on the map
Listings describe real-world places, and real-world places change. Opening hours move, stands close, stock runs out, a farm stops selling eggs. Some listings are submitted by other users. We do not verify every listing, and we do not warrant that any listing is accurate, current or complete.
Listings come from our own directory of farms and markets together with places submitted by users through Add Farm. Treat what you see in the app as a starting point, and confirm the things that matter to you — hours, prices, what is actually in stock — with the place itself before you travel.
Distances shown in the app are approximate and depend on the location your device reports. Do not rely on the app for navigation-critical decisions.
What you submit
The app lets you add a farm or market that is not on the map. When you submit something, you confirm that:
- the information is accurate to the best of your knowledge;
- you have the right to submit it, and it does not infringe anyone’s rights;
- it does not contain another person’s private information — a private home address, or personal contact details a business does not publish itself.
Submissions are meant to be published. By submitting, you give us a non-exclusive, worldwide, royalty-free licence to store, reproduce, adapt for formatting, publish and display that content in Grownhome and in material promoting it, for as long as the listing remains in the app. You keep whatever rights you already had in what you submitted.
We may edit a submission for accuracy or formatting, decline it, or remove it later. We are not obliged to publish anything you send.
Acceptable use
Do not use Grownhome to:
- submit false, misleading or spam listings, or listings for places that do not exist;
- submit content that is unlawful, hateful, harassing, threatening or obscene;
- impersonate a farm, business or person, or claim an affiliation you do not have;
- publish someone’s private information, or use a listing to target or harass anyone;
- scrape, bulk-download or copy the listing data to build a competing product, or resell it;
- interfere with the app or the systems behind it, or try to get around a technical limit or security measure;
- break the law, or the terms of a third-party service the app relies on.
Free trial, subscription and billing
Grownhome starts with a free trial of 7 days. Unless you cancel before the trial ends, it converts into a paid subscription and you are charged for the first period.
The price, the length of each billing period and the terms of the current offer are shown in the app before you confirm. They are not repeated on this website, because the store shows you the real price in your own currency and a figure copied here would eventually be wrong. Prices may change; where a change affects a subscription you already hold, you will be told in advance and it will apply from a following billing period, never retroactively.
Subscriptions are sold and billed by the App Store or Google Play, not by us. Payment is taken by the store using the payment method on your Apple or Google account, and we never see or handle your card details. Your subscription renews automatically at the end of each period until you cancel, and the store charges you within the 24 hours before each renewal.
Your purchase is also subject to the store’s own terms. Where the store’s rules and these terms differ on billing, the store’s rules govern the payment itself.
Cancelling and refunds
You cancel through the store, not through us — we have no ability to cancel a subscription on your behalf:
- iPhone or iPad:Settings › your name › Subscriptions › Grownhome› Cancel Subscription.
- Android:Google Play › profile icon › Payments and subscriptions › Subscriptions › Grownhome› Cancel.
Cancel at least 24 hours before the trial or the current period ends, otherwise the next period is charged. Cancelling stops future renewals; you keep access until the end of the period you have already paid for. Deleting the app does not cancel a subscription.
Refunds are handled by Apple and Google under their own policies, because they took the payment. Request one through the store you bought from. This does not affect any refund or cancellation right you have under the consumer law where you live, including in Quebec, Canada, which applies regardless of what this section says. Dealing with farms and sellers
Anything that happens between you and a farm, market or seller is between you and them. That includes what you buy, what you pay, what condition it arrives in, whether they turn up, and how they handle your information when you contact them.
We do not promise, and cannot promise, any of the following about a listed place:
- the quality, freshness or safety of its food;
- that its labelling claims — organic, pasture-raised, grass-fed or otherwise — are true or certified;
- that it holds any licence, permit, certification or insurance;
- that it complies with food-safety or any other regulation;
- that it is open, that stock is available, or that a price is current;
- the identity or trustworthiness of the people who run it.
Use ordinary judgement, the same as you would with any business you found any other way. If a place is unsafe or fraudulent, please also tell us so we can review the listing.
Deals, prices and availability
Where the app shows a deal or a price, that information originates with the seller and can change or expire without notice. We do not set prices, honour deals or provide refunds, because we are not the seller. Any offer is between you and the place offering it.
To be clear about the two different kinds of money involved: the only thing you buy from us is the Grownhome subscription described above, which pays for access to the app. Anything you buy from a farm or market you found through the app is a separate transaction with that seller, taken outside the app, and we are not a party to it.
Maps and other third-party services
The map is drawn using Mapbox. Your use of the map is also subject to Mapbox’s terms, and the map data itself — roads, place names, boundaries — belongs to Mapbox and its data sources, not to us.
Links out of the app to a farm’s website, phone number or social page are for convenience. We do not control those destinations and are not responsible for them.
Reporting content and moderation
If a listing is wrong, a place has closed, someone has submitted content they should not have, or you are the owner of a place and want a listing corrected or removed, email grownhome.team@gmail.com and tell us which listing you mean.
We may remove or edit any listing or submission, and we may stop someone from using the app, when we believe these terms have been broken or a listing is harmful, unlawful or false. Because the app has no accounts, enforcement is limited to removing content and, where necessary, restricting access at a technical level.
Availability and changes
Grownhome is provided as it is, when it is available. We may change, add or remove features, and we may suspend or discontinue the app. We do not guarantee uninterrupted service, and the app depends on things outside our control, including your device, your network and the third-party services described above.
If we discontinue Grownhome while you hold a paid subscription, we will stop further renewals and, for any period you have paid for but cannot use, you may seek a refund from the App Store or Google Play under its refund policy.
Disclaimers and limitation of liability
To the fullest extent permitted by law, Grownhomeis provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be error-free, that listings are accurate, or that any place you find through it will meet your expectations.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or any loss arising from your dealings with a farm, market or seller you found through the app — including anything you buy from them.
Nothing in these terms limits any liability that cannot be limited under the law that applies to you, such as liability for death or personal injury caused by negligence, or for fraud. Because Grownhome is a paid service, consumers keep the legal warranties their own law gives them — including, in Quebec, Canada, the warranties under consumer protection legislation, which cannot be excluded by a contract term.
You agree to cover our reasonable losses if they arise from your misuse of the app or from content you submitted in breach of these terms.
Governing law, changes and contact
These terms are governed by the law of Quebec, Canada, without regard to its conflict-of-laws rules, and disputes will be heard by the courts of that place. You keep any right you have under local consumer law to bring a claim where you live.
These terms contain no mandatory arbitration clause and no class-action waiver. Neither has been agreed, so neither is asserted here.
We may update these terms. When we do, we change the effective date at the top of this page, and we will flag material changes in the app. Continuing to use Grownhome after a change means you accept the updated terms.
